A Morley man pleaded guilty to dangerous driving charges that resulted from his vehicle crashing into a ditch and injuring several passengers.
Graham Evans Holloway pleaded guilty to dangerous driving under the Criminal Code in Canmore Provincial Court earlier this month.
The car accident occurred on June 21, 2009 and Crown prosecutor Doug Simpson said at the time of the single vehicle rollover, Holloway was the driver, had been consuming alcohol and was travelling at a high rate of speed.
He added when the vehicle flipped into the ditch off the Trans-Canada Highway, passengers in the vehicle were injured as a result.
Simpson said a number of legal issues in the case resulted in the Crown agreeing to a conditional sentence for dangerous driving and withdrawing three charges of impaired driving causing bodily harm and driving while disqualified.
Defence counsel Rebecca Snukal said the joint submission for a conditional sentence of one year to be followed by a year of probation was also to help Holloway address his substance abuse issues.
Snukal said the community supervision the CSO provides will help him with that.
Holloway will spend the first four months under 24 hour house arrest followed by four months with a curfew between 9 p.m. and 6 a.m.
He was also ordered to abstain absolutely from consuming alcohol and continue counseling or treatment as directed by probation.
Judge Eugene Creighton, who is a member of the Blood Tribe and Kainai First Nation, said alcohol is a real problem in native communities and is something that people struggle with everyday.
“There are factors that contribute to that, but it is something like this that can open your eyes and get you to quit drinking,” said the judge.
