Man guilty of Canmore drunk tank assault sentenced to 90 days

CALGARY – A man found guilty of sexual assault while being held in custody by Canmore RCMP in the drunk tank was sentenced to a 90-day intermittent jail sentence and two years probation on Tuesday (May 21).

After a weeklong trial at the Court of Queen’s Bench in Calgary in front of Justice Hughes and a jury last June, Derek Bradley was found guilty of the assault.

Bradley and the complainant were both arrested in Canmore on Aug. 19, 2016 for public intoxication where it was alleged Bradley sexually assaulted his cellmate.

Video surveillance captured Bradley “groping” the complainant in the drunk tank that night and was shown as evidence during the trial.

“Both men have no memory of the incident, but we have the video footage of the [assault],” said Crown prosecutor Britta Kristensen.

Kristensen said the trial started on a Monday, June 11, 2018 and finished on a Friday, June 15, 2018 at 9 p.m. after less than a day of deliberation for the jury.

The complainant cannot be identified under a publication ban.

The 90-day jail sentence is intermittent, meaning Bradley can serve his prison time on weekends and return to his home during the week.

Bradley also has a five-year weapons ban, has to register for 20 years with the Sex Offenders Information Registration Act (SOIRA) and complete a DNA order.

“The probation includes terms that he attend counselling and have no contact with [the victim],” Kristensen said.
