Conditional bail granted in Canmore assault case

A man accused of assaulting a 10-year-old girl in Canmore at the beginning of August has been released from custody with the condition that he leaves the province of Alberta.

A man accused of assaulting a 10-year-old girl in Canmore at the beginning of August has been released from custody with the condition that he leaves the province of Alberta.

Judge Judy Shriar put over the show cause hearing from Canmore Provincial Court last Wednesday (Sept. 2) to a Calgary courtroom on Thursday afternoon (Sept. 3) for defence counsel Dale Fedorchuk to put together a better release plan for the 20-year-old.

“This bail can be tailored in a way to satisfy the concerns of a reasonable member of the public,” Fedorchuk said.

Shriar granted the accused, Benjamin Danby, release with a $10,000 surety no deposit bail with the condition that he return home to Innisfil, Ont. to stay with his parents and can only return to Canmore for court.

Originally, Fedorchuk proposed Danby be released into the community and live with his girlfriend. However, the fact that her residence is 200 metres from where the victim of the alleged assault lives was a problem for Shriar.

Danby is charged with unlawfully confining and assaulting the young victim after an Aug. 6 incident at 4:15 p.m. outside her residence. Danby was also charged with voyeurism after being found with photographs of women taken without their permission after his arrest.

His next court appearance is Oct. 14.
