Proposed Bylaws

The proposed bylaws are three (3) separate, but related bylaws initiated by the MD of Bighorn to facilitate the future construction of the MD’s new Operations Facility. The 3 bylaws include: 1. Land Use Bylaw (LUB) Amendment Application for the redistricting of one parcel from HT to RI; 2. Municipal Development Plan (MDP) Amendment for the Exshaw hamlet boundary adjustment; and 3. Road Closure Application to close a portion of the Government Road Allowance which lies between NW ¼ Sec. 24-24-9-W5 and SW ¼ Sec. 25-24-9-W5, and to close a portion of the Government Road Allowance which lies between NE ¼ Sec. 23-24-9-W5 and NW ¼ Sec. 24-24-9-W5, both of which are located within the Hamlet of Exshaw.

Purpose

  1. The LUB Amendment is to redistrict Lot 2; Block 1; Plan 231 0175, from the Hamlet Transition District (HT) to the Rural Industrial District (RI). The proposed redistricting of the subject property aligns with the provisions of the LUB, and the purpose and intent of both the HT District and the RI District. It will allow flexibility for the construction of the proposed Operations Facility development and to align the Land Use District with the remainder of the proposed site within the Rural Industrial District. See Map 1. 2. The purpose of the Municipal Development Plan Amendment is to remove Lot 2; Block 1; Plan 231 0175 from the Hamlet of Exshaw boundary in the MDP Figure 5 – Future Land Use Map, and to redesignate a portion of this area from Industrial to Rural Industrial in the MDP Figure 1 – Future Land Use Map. See Maps 1, 2, and 3. 3. The Road Closure Application is proposed to close a portion of two road allowances (labelled as Area “A” and Area “B” in the Survey Plan) adjacent to the recently acquired MD of Bighorn lands located at Lots 1 and 2; Block 1; Plan 231 0175, southwest of the existing Graymont Plant. See Map 4. The Public Hearings for these three bylaws are consecutive because the bylaws are related, and the outcome of one may affect the other. The MD of Bighorn has not submitted a Development PermitApplication forthe new Operations Facility.The public and adjacent landowners will be notified for comments once a Development Permit Application for the new Operations Facility is received and being considered for decision.

 

Representation

The public hearings for proposed Bylaw 11-Z/23, Bylaw 12-23, and Bylaw 27-23 will provide the public with an opportunity to address Council. Verbal and written comments and suggestions are invited and should be addressed to the point of the draft bylaw(s). They may be made by any person or group of persons, or a person acting on their behalf, who claims to be affected by the proposed draft bylaw(s); and from any other persons whom, at the hearing, Bighorn Council wishes to hear. Participation at the public hearing is open to the public in Council Chambers at the MD of Bighorn Municipal Office. The public hearing will be live streamed on the MD YouTube Channel.

 

Written submissions may be made electronically to [email protected], and can be mailed or dropped off at the Municipal Office at #2 Heart Mountain Drive, P.O. Box 310, Exshaw, Alberta, T0L 2C0 by the date indicated below. There is a drop box located on the front of the building for your convenience. Written submissions received before 4:00 p.m. on Monday January 29, 2024, will be part of a record of public submissions published by 6:00 p.m. January 30, 2024, and will be distributed to Council. Submissions received after the deadline, but before the close of the hearings, will be added to the record after the hearing adjourns. Verbal presentations may be made at the Public Hearings by individuals or groups (as described above), whether they have submitted a written presentation or not. Verbal presentations should be limited to five (5) minutes, except in the case of a person speaking as a representative for a group of persons who may speak for a maximum of ten (10) minutes. Other Information After the Public Hearings, these bylaws will be brought back to a future Council meeting(s) for further consideration by Council.
